The Planning and Building (Caravans) (Jersey) Order 2023 Article 4 (4) (a) states that if a motorhome is not on a designated camp site it may be stationed out of view on privately owned land . [ for clarity the term motorhome is defined in the Planning and Building Law 2002 Article 98 (b) and further definitions such as DVLA in UK regard a van derived vehicle as not a motorhome but a chassis developed vehicle with side doors , additional windows , shower and toilet , and capable of 'habitation' ie long term living contained within the vehicle as a motorhome]. From the numerous examples of motorhomes on private property but clearly visible by the public (just one attached for reference), it is obvious that this order is not being enforced.
a. What is the policy for enforcement of the relevant Order if any?
b, Have any interventions to resolve a breach of the Order been applied since its 2023 commencement?
Response
A
The Scheduled Public Authority (SPA) does not hold a specific enforcement policy relating to motorhomes, therefore Article 3 of the Freedom of Information applies.
The SPA’s approach to enforcement is provided in the link below:
Enforcement Policy - Regulation Directorate
The Regulator's Code is shown in the link below:
Regulators' Code
B
There have been no investigations into motorhomes since 2023.
