Disability Discrimination Consultation: Summary of Responses

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Disability Discrimination Consultation summary of responses - Presentation as a Report to the States Assembly.

Decision(s): In accordance with States’ best practice, the Minister decided to present to the States Assembly a report on the outcomes of her public consultation on disability discrimination.

Reason(s) for Decision: Best practice for States’ consultations requires that the States Assembly is notified of the outcomes of any consultation paper.

 

The Minister consulted during September to November 2017 on draft Regulations that would be made under the Discrimination (Jersey) Law 2013 to introduce protection against disability discrimination. The Minister invited comments from stakeholders on a number of policy issues including how we should define ‘disability’ for the purpose of this law, whether any exceptions should be made and physical adjustments to premises. This report sets out an overview of the responses received to each survey question, including quotes from some of the respondents to give an indication of the range of responses and to allow some of the specific issues raised by respondents to be considered and addressed by the Minister. The Minister’s proposals were generally supported by respondents. Minor revisions were made to the draft Regulations to reflect some of the outcomes of the consultation.

Resource Implications: There are no financial or manpower implications.

Action required: Policy Principal to request the Greffier of the States to present the document as a Report to the States on Monday 29 January 2018 to coincide with the lodging of the draft Discrimination (Disability) (Jersey) Regulations 201-. (MD-S-2018-0007)
