Fort Regent Political Oversight Group: Terms of reference

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Fort Regent Political Oversight Group (POG) – Terms of Reference 

Purpose

To oversee the re-development and delivery of Fort Regent in line with the decisions of the Council of Ministers (CoM) and States Assembly.

Group Member Roles

 

The Board will operate according to the following principles of good corporate governance:

 

  • Leadership – articulating a clear vision for the future of Fort Regent and giving clarity about how policy activities contribute to achieving this vision, including setting risk appetite and managing risk;

 

  • Effectiveness – bringing a wide range of relevant experience to bear, including offering rigorous challenge and scrutinising performance; 

 

  • Accountability – promoting transparency through clear and fair reporting; 

 

  • Sustainability – taking a long-term view about what the government is trying to achieve and what it is doing to get there.

 

Board Member Responsibilities

 

Provide strategic oversight of the development of a Delivery Plan for Fort Regent by advising on, and supervising progress towards outcomes, via five main areas:

 

  1. Strategic Clarity – supporting the Council of Ministers to set the vision and/or mission and ensuring all activities, either directly or indirectly, contribute towards it; long-term capability and horizon scanning, ensuring strategic decisions are based on a collective understanding of policy issues (including legislation); using outside perspectives to ensure that departments are challenged on the outcomes; 

 

  1. Commercial Sense – approving the distribution of responsibilities; advising on sign-off of large operational projects or programmes; ensuring sound financial management; scrutinising the allocation of financial and human resources required to achieve the Plan; ensuring organisational design supports attainment of strategic objectives; setting risk appetite and ensuring controls are in place to manage risk; evaluation of the Board and its members, and succession planning;

 

  1. Talented People – understanding the capabilities needed to deliver and to plan to meet current and future needs; 

 

  1. Results Focus – supporting the Council of Ministers in identifying the priorities of the Government, including strategic aims and objectives; monitoring and steering performance against the Delivery Plan.

 

  1. Management Information – ensuring clear, consistent, comparable performance information is used to drive improvements.

 

Scope

 

The scope of the Fort Regent Political Oversight Group includes:

 

  • Oversee a delivery plan for the long-term redevelopment of Fort Regent.
  • Close coordination with the Inspiring Active Places Programme which will be responsible for the provision of alternative facilities for existing sports users of Fort Regent.
  • Oversee the delivery of interim uses and placemaking activities during the development of the project
  • Oversee access projects required to enable re-development.
  • Ensure close coordination with concurrent major project plans.

 

In addition, the Group will align and support the wider work being undertaken by the Regeneration Steering Group, as the overall group that politically coordinates the government’s approach to public property assets and infrastructure projects.

  • Minister for Economic Development, Tourism, Sport and Culture (Deputy Chief Minister)
  • Assistant Minister, Economic Development, Tourism, Sport and Culture, with responsibility for Sport; and Assistant Minister, Infrastructure, Deputy Raymond (Deputy Chair)
  • Assistant Minister, Economic Development, Tourism, Sport and Culture, with responsibility for Culture, Deputy Morel
  • Minister for Treasury & Resources
  • Minister for Infrastructure
  • Connétable of St Helier
  • Deputy St. Helier No. 1, Deputy Wickenden

 

The meeting will quorate if the Chair (or Deputy Chair) plus three other members of the Group are in attendance.

 

 

Record Keeping and Reporting

 

Minutes of meetings will be taken to ensure that a proper record is maintained.  These minutes may be confidential where key work streams and projects are commercially sensitive.

 

Progress reports will be provided as required to the Council of Ministers; and the States Assembly, Scrutiny and PAC where appropriate.

 

Administrative Arrangements

 

  • The Chair will approve agendas
  • Meetings will take place at least quarterly or as required by the Board
  • Any additional meetings that may be required will need prior approval from the Chair
  • The Private Secretary to the Minister for Infrastructure, or other staff as so delegated, will provide the secretariat support to the Fort Regent POG including keeping minutes
  • Membership of the Board will be reviewed on an annual basis by the Board
  • If a Board member is unable to attend a meeting their nominated and approved deputy may attend on their behalf
  • If a member of the Board (or their deputy) is unable to attend for three consecutive meetings the Board will consider their continued membership or replacement
  • The Board may invite stakeholders to attend for, or to present, specific items as appropriate.
