Sale of 39 Midvale Road, St. Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister,

  1. approved the sale of 39 Midvale Road to Mr Paul Martin Sinel and Mr Carlos Manuel Mendonca Vieira jointly for the sum of £500,000
  2. requested that the Treasury & Resources Minister similarly agree and seek the assistance of the Greffier and Attorney General in signing the necessary contracts. 
  3. directed that the resultant funds be credited to HYC029.120410

To ensure that the sale is carried out in accordance with Standing Order 168 and the States approval of P6.2007.

REPORT TO THE HOUSING MINISTER  

39 Midvale Road- Sale  

On 17th July 2007 the States approved P6.2007 The Social Housing Property Plan 2007 – 2016.  This provided approval for the sale on the open market of a number of non-core properties which were owned by the Public of the Island and were in the stewardship of the Housing Department.  39 Midvale Road was included on the list of proposed sales which was ultimately agreed. 

On 5th October 2007, the Minister will recall that he agreed to place 39 Midvale Road on the open market for sale. 

The property had been valued in accordance with the approved valuation policy MD-H-2007-0057 refers on 1st October 2007.  The valuation set is therefore valid until 29th December 2007. 

An offer to purchase the property at the full asking price of £500,000 has been received from Mr Paul Martin Sinel and Mr Carlos Manuel Mendonca Vieira jointly.  This will be a cash purchase, there is no onward chain. 

The purchasers have indicated that they intend to pass contract on or before 30th November 2007. 

Recommendations  

That the Minister,  

1. approve the sale of 39 Midvale Road for the sum of £500,000 to Mr Paul Martin Sinel and Mr Carlos Manuel Mendonca Vieira jointly 

2. request that the Treasury & Resources Minister agree to the transactions and authorises the Greffier and Attorney General to sign the necessary contracts.   

3. that in accordance with the States approval of P6.2007 the resultant funds are to be credited to HYC029.120410
