Westmount Road, St. Helier: Zebra Crossing

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ZEBRA CROSSING ON WESTMOUNT ROAD, ST HELIER

 

 

Purpose of the Report

 

To consider a request by the Parish of St Helier to install a zebra crossing on Westmount Road as required under Article 69 of the Road Traffic (Jersey) Law 1956.

 

 

Background

 

The Parish of St Helier have requested the Minister consider their proposal for a zebra crossing on Westmount Road to enable residents from the new Westmount development, Andium Homes and the Parish Nursery to cross Westmount Road to access People’s Park.

 

 

Proposal

 

The proposal is detailed in drawing number 70033872-PD-0100-DRG_0002 Rev P01 attached as Appendix 1.  It includes Belisha Beacons, tactile paving, warning signs and appropriate road markings. The zig-zag markings are shorter than standard, but the reduced length is appropriate given the proximity of adjacent side roads and the Minister can authorise this change of detail. The drawing includes a short length of 20mph limit, however Westmount Road will be considered as a whole during the upcoming speed limit review which will look at all roads in St Helier outside the Ring Road and Havre des Pas areas which were reviewed in 2018/19.

 

 

Recommendation

 

The Minister is recommended to approve the installation of the zebra crossing as shown in drawing number 70033872-PD-0100-DRG_0002 Rev P01 with the exception that the speed limit changes will be considered separately through the Speed Limit Review process alongside the speed limit on other roads in St Helier.

 

 

Reason(s) for Decision

 

This decision is required as under Article 69 of the Road Traffic (Jersey) Law 1956, only the Minister for Infrastructure can approve the installation of a zebra crossing.
