Health and Social Services: Delegation of Functions: September 2014 (R.147/2014)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Delegated Functions, States of Jersey Law 2005- September 2014 delegation of functions under the Medical Practitioners (Registration) (Jersey) Law 1960 and Piercing and Tattooing (Jersey) Law 2002

 

Decision(s):  The Minister for Health and Social Services approved the schedule of delegated functions dated September 2014

Reason(s) for decision:

 

  • In July 2011 the States Assembly approved amendments to Medical Practitioners (Registration) (Jersey) Law 2014 which was necessary to satisfy the UK General Medical Council (GMC) that doctors working in Jersey meet the required standards and continue to be fit to practise.  This amendment is due to come into force on 1 October 2014
  • Two supporting Orders, The Medical Practitioners (Registration) (General Provisions) (Jersey) Order 2014 and the Medical Practitioners (Registration) (Responsible Officer) (Jersey) Order 2014, were made on the 15 September and come into force on 1 October 2014.
  • The attached schedule of delegation provides for the Medical Officer of Health or in her absence, her deputy to undertake the Minister’s functions as registrar and to appoint responsible officers to make recommendations to the General Medical Council of the UK relating to the revalidation of doctors in Jersey.
  • The schedule also includes an updating of the delegation of functions under the Piercing and Tattooing (Jersey) Law changing the designated officer from Environmental Health Officers to any person the Medical Officer of Health deems suitable and is necessary to reflect restructuring of the regulatory functions within the Public Health Directorate.

Action required: For the Greffier to add the attached schedule to the Delegated Ministerial functions for the Health and Social Services Department and present this to the States.
