Change of use of carry forward budget: Pandemic Flu strategy to Ebola threat safeguards

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Health and Social Services (HSS) request for a change of use to a carry forward budget relating to the investment in the Pandemic Flu strategy to be used towards the costs of safeguarding islanders against the threat of Ebola.

Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

HSSD – Change of Use of Carry Forward Budget

1.                                           Purpose of Report

To request the Minister of Treasury and Resources approves the change of use of the carry forward budget amount.

2.                                           Background
 

A new pandemic flu strategy was agreed by the Council of Ministers in September 2013. An amount of £25,000 was allocated in the 2014 carry forward budget to allow implementation of this strategy. HSSD is progressing a tendering process in line with the requirements of Financial Direction 5.1. It is anticipated this will be completed in 2015. This amount is therefore not required in 2014.

 

There is currently a large Ebola outbreak (considered by WHO as a public health emergency of international concern) caused by the Zaire strain of the virus primarily affecting Sierra Leone, Liberia, Guinea.  The outbreak is currently not considered to be under control. There is a need to implement safeguarding measures in the event that HSSD would need to manage an Ebola case locally. The safeguarding strategy includes the purchase of high level personal protective clothing along with the training of clinical staff in appropriate procedures. The estimated costs for 2014 are £19,300.

 

It is requested that an amount of £19,300 originally allocated to implement the Pandemic Flu strategy be used to fund the purchase of Ebola protective clothing and implementation of the overall strategy in safeguarding islanders against infectious diseases.

The Minister of Health and Social Services is recommended to approve the change in use of the carry forward budget amount.
