1. Introduction
The Teachersā Superannuation (Jersey) Law makes provisions in relation to pensions and other similar benefits payable to, and in respect of, teachers and certain other persons employed in connection with the provision of educational services. Changes are required to the existing legislation to give effect to the former Education, Sport and Culture Committeeās in principle decision to align teachers benefits to Jersey public sector pension benefits.
2. Background
2.1 An amendment to the Teachersā Superannuation (Jersey) Law 1979 has been lodged au Greffe (P69/2006) which makes changes to the governance arrangements to reflect the impact of Ministerial government, to allow the Fund to be administered by a Management Board and to allow for pension increases to be funded from the Fund. A debate date of 18 July 2006 has been requested.
2.2 Following the implementation of ministerial government, the States Employment Board become the legal employer of all Statesā employees, except certain office holders, such as the Police and those posts referred to in the Departments of the Judiciary and Legislature (Jersey) Law 1965. Prior to 2006 the Education, Sport and Culture Committee was the employer for teaching staff in Jersey.
2.3 As the States Employment Board is administered by the Chief Ministerās Department a further amendment is required to the Teachersā Superannuation (Jersey) Law 1979 to allow for the definition of Minister to be that of the āChief Ministerā rather than the Minister for āEducation, Sport and Cultureā.
3. Recommendations
It is recommended that the Minister:
a) approves the Draft Teachersā Superannuation (Amendment No 2) (Jersey) Law 200- (P69/2006) ā Amendment and covering report;
b) lodges the Draft Teachersā Superannuation (Amendment No 2) (Jersey) Law 200- (P69/2006) ā Amendment and covering report with the Greffe on 4 July requests a debate date of 18 July 2006.
