Draft Code of Practice to be made under the Employment Relations (Jersey) Law 2007 - released for public representations.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to approve that the draft codes of practice which will be made under the Employment Relations (Jersey) Law 2007 should be issued for representations from the public.


Reason(s) for decision:

The Employment Relations (Jersey) Law 2007 requires that before approving any codes of practice under that Law, a notice must have been published in the Jersey Gazette stating where and for how long (not less than 28 days) the codes of practice will be available for inspection and explaining that anyone may make representations to the Minister on those codes.

The Gazette notice will specify the following -

The Minister has decided to issue three such codes of practice on the matters of:

  1. The Recognition of Trade Unions
  2. Balloting and Conduct in Employment Disputes
  3. Resolving Collective Disputes.

 

Copies of the draft Codes will be available on the Department’s website.

Copies will be available free of charge, by post or email, from the Social Security Department, telephone 447203, email k.morel@gov.je, or may be collected from the Reception of the Social Security Department on La Motte Street.

Representations on the draft codes must be received by the Department, either in writing to Kate Morel, PO Box 55, La Motte St, St Helier, JE4 8PE, by email to k.morel@gov.je, or may be made in person to the Minister by arrangement with the Department, tel. 447203, no later than Thursday 18th October 2007.

Following consideration of any representations made to the Minister, the resulting codes of practice will be made available to the public and will come into force with the Employment Relations Law.


Action required:

Publish the notice in the Gazette inviting representations from the public on the codes of practice.
