Department of the Environment: Fees and Charges 2016: Approval / Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Department of the Environment

Changes to Fees and Charges 2016 Report

It is recommended that the Department of the Environment fees and charges are amended as at 1st Jan 2016 as follows:

General Fees and Charges

Unless otherwise detailed below, Department of the Environment fees and charges will remain at 2015 levels.

Planning and Building Fees

Planning Appeals System

In order to fund the new Planning and Building Appeals System following the removal of funding opportunities from the Medium Term Financial Plan 2016 to 2019 ‘part 1’ (MTFP), the following fee changes will be made:

  1. All Planning and Building fees will increase by approximately 1.5% on the 1st January 2016. The income generated from this increase will offset the Judicial Greffe estimated annual administration, management and premises costs of £44,200 associated with operating the Planning Appeals system. These costs were presented to the States in P.87/2013 Comment, on the 10th Sept 2013 by the Minister for Treasury and Resources.
  2. Planning and Building Appeal fees will increase from £100 to £400 and from £300 to £1,200, to offset the estimated inspector fees and expenses associated with operating the Planning Appeals system. These costs were presented to the States in P.87/2013 by the Minister for Planning and Environment.

Fee Descriptions

Four fee descriptions will be changed to better reflect the types of development included in the fee and to improve the applicant and stakeholder understanding.

Building Control

A new fee will be introduced in relation to a dwelling house with a floor area exceeding 200 square metres, to better reflect the costs associated with processing large single house applications.

Plant Health

The Plant Health field inspection and bulb inspection of Narcissus (per vergee) fee will increase from £11.00 to £11.50, to support a move towards full cost recovery.

Waste Management

A ‘periodic renewal fee’ matching the existing registration fee is being introduced.

The detailed changes are set out in the Department of the Environment – Changes to Fees and Charges – 2016 Schedule.
