To seek support for the approval of a J category licence for the post of Assistant Director Environmental Management & the Rural Economy.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Economic Development agreed the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1979, Regulation 1(1)(j) for the post of Assistant Director, Environmental Management & the Rural Economy.

Reason(s) for Decision:

  • A local recruitment campaign during the spring of 2008 attracted two candidates for this post.  The candidates were short listed for interview.
  • A local candidate was offered the position but declined the role due to his own personal circumstances; as a consequence the panel was unable to make an appointment.
  • The role of Assistant Director, Environmental Management & the Rural Economy is absolutely essential to provide advice on Environmental Management and the Rural Economy to the Departments of Planning and Environment and Economic Development and the Ministers.  It therefore fulfils the criteria of ‘essential’ as defined under the housing regulations

Resource Implications:

  • This is an existing post to be replaced.  The role is 1 fte at grade 14. 

Action required:

  • The Chief Executive Officer to make an application to the Population Office for a "J" category Licence to be granted for the post of Assistant Director,  Environmental Management & the Rural Economy under the auspices of the Housing (General Provisions) (Jersey) Regulations 1970, Regulation 1(1)j;
  • Subject to the approval of the application to the Population Office, the Economic Development Department will appoint a suitably qualified and experienced candidate from outside of the Island to fill this post.
