Criminal Offences Confiscation Fund (COCF): Seek approval of Minister for Treasury and Resources to use income received for assessment of prisoners in specialist centres in UK

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to seek the approval of the Minister for Treasury and Resources to use the income of £714,000 received from the COCF to fund the assessment of prisoners in specialist centres in the UK.

Reason(s) for Decision:

An application was made to the COCF for funding to contribute towards the assessment of prisoners in specialist centres in the UK.

 

Article 19(1)(a) of the Public Finances (Jersey) Law 2005 states that if, during a financial year, the Minister is satisfied that the income of a States funded body is likely to exceed its estimated income, the Minister may authorise the body to withdraw from the consolidated fund during that year an amount not exceeding the likely excess of income. 

 

Resource Implications:

This decision results in additional revenue income of £714,000 being received by HSSD and applied to the extraordinary revenue expenditure on the specialist assessment of prisoners in the UK.

 

This Decision does not impact on approved FTE or change the total amount of net expenditure approved by the States.

 

 

Action required:

Assistant Director of Finance to advise the Head of Financial Management, Reporting and Accounting, Treasury and Resources Department that this decision has been approved.

Application of Criminal Offences Confiscation Fund (COCF) funding to the Assessment of Prisoners in the UK

1.                  Purpose of Report

The purpose of this report is to seek the approval of the Minister for Treasury and Resources to use the income of £714,000 to fund extraordinary expenditure of £714,000 on the assessment of prisoners in the UK.

2.                  Background

HSSD has budget to meet its average requirement to send one prisoner at HMP La Moye per year to the UK for specialist mental health assessments.

 

In June 2014, funding was requested from the COCF in respect of four prisoners who were transferred to a UK secure provision to receive specialist mental health assessment and treatment. On average each placement lasts 6 to 12 months and costs up to £250,000. The estimate of £714,000 was based on the initial assessments of the individuals concerned by the specialist centres, less the sum already budgeted for one assessment.

 

The purpose of the short term placements in specialist provision in the UK is to provide expert assessment resulting in a sustainable treatment plan and improved medication compliance.

The impact of the placements is to minimise the risks of harm to the prisoners and the prison population, reduce the likelihood of the prisoners re-offending and protect the community at large by specialist treatment of their mental illness.

  1. Recommendation

 

It is recommended that the Minister seeks the approval of the Minister for Treasury and Resources to use the income of £714,000 received from the COCF.

 

  1. Reason for Decision

 

Article 19(1)(a) of the Public Finances (Jersey) Law 2005 states that if, during a financial year, the Minister [for Treasury and Resources] is satisfied that the income of a States funded body is likely to exceed its estimated income, the Minister may authorise the body to withdraw from the consolidated fund during that year an amount not exceeding the likely excess of income. 

Approval is therefore required from the Minister for Treasury and Resources for the Health and Social Services Department to use the income of £714,000 from the COCF in accordance with section 5.14 of Financial Direction 3.6, Variations to Heads of Expenditure.

 

  1. Resource Implications

 

This decision increases the income received by HSSD by £714,000 to meet extraordinary expenditure already incurred.
