Prescribed List Amendments: 1 June 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Rescindment of previous Ministerial Decision and re-statement of changes to the Prescribed List as at 1 June 2012

Decision(s):   The Minister rescinded MD –S – 2012-0032, made on 30 April 2012, and decided to reinstate the amendments to the Prescribed List included therein, but respecting the commercial confidentiality in respect of the inclusion of a specific item on the prescribed list.

Reason(s) for Decision:

The Pharmaceutical Benefit Advisory Committee met on 27 March 2012 and provided the Minister with the accompanying written report setting out its recommendations in respect of amendments to the Prescribed List.

 

The changes reflect current evidence and expert advice, and ensure that patients in Jersey have access to an appropriate range of modern, safe and effective treatments from their GPs at a proportionate cost to the Fund.

 

The written report includes commercially sensitive information.

Resource Implications:

The addition of three new items to the List represents an estimated additional cost to the Fund of around £390,000 per annum.  

 

There will also be price reductions following patent expiry for sixteen items including some key high-cost medicines in 2012, with an estimated saving of £500,000 pa in a full year.    The cost saving in 2012 will depend on the timing of the expiry of each licence and the price level at which the generic products stabilise.

Action required:

Policy and Strategy Director to request the Greffier of the States to remove the previous ministerial decision from the government website.  Policy and Strategy Director to confirm amendments to prescribed list to all approved medical practitioners and approved contractors.
