Jersey Sport - Grant Funded Body: Establishment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Jersey Sport - Establishment: report and proposition

Decision(s):

The Assistant Minister with responsibility for sport rescinded Ministerial Decision MD-E-2017-0009 and approved the revised report and proposition entitled: ‘Jersey Sport – Establishment’ and determined that it should be lodged ‘au Greffe’ as soon as practicable and with a view to securing a States debate on 23rd May 2017.

Reason(s) for Decision:

Ministerial Decision MD-E-2017-0009 has been rescinded because amendments to the proposition were deemed necessary in order to clarify the decision the States were being asked to take.

 

The revised proposition is necessary to ensure compliance with the States decision in respect of P.170/2010 (‘Shadow Board and Ministerial Boards: Approval by the States’). It advocates the establishment of a new and independent grant-funded body to oversee sport development in the Island in accordance with the strategy: ‘Fit for the Future’ (R.9/2014) and two subsequent reports produced by specialist sports consultancy Knight Kavanagh Page and the Jersey Sport Shadow Board.

 

Connétable S.W. Pallett of St. Brelade retains delegated authority for sport policy in accordance with the terms of R.181/2014.

Resource Implications:

Resource implications are set out in full in the report accompanying the proposition.  The overall budget associated with the new organisation is in accordance with that outlined for Jersey Sport at page 80 of the MTFP 2017 Addition and pages 72 – 75 of the MTFP Annex 2017 – 2019.

Action required:

Report and proposition to be forwarded directly to the States Greffe. The Greffier of the States is requested to arrange for the proposition to be lodged ‘au Greffe.’
