Tourism Development Fund Grant: Acceptance of funds from Central Reserve

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Tourism Development Fund: Acceptance of funds from Central Reserve - grant

Acceptance of £450,000 from the Central Reserve to grant £450,000 to the Tourism Development Fund

Issue

In the debate on the draft Annual Business Plan 2012, a commitment was made to grant £450,000 to the Tourism Development Fund (TDF) from within existing States spending limits. This proposal honours this commitment.

Background

Senator Le Gresley lodged an Amendment (P123/2011 Amd (3)) to the draft Annual Business Plan 2012 to increase the net revenue expenditure of the Economic Development Department by £1 million in order to provide a grant of this amount to the Tourism Development Fund in 2012.

In response, recognising the value of the TDF’s contribution to the Tourism Sector, a Comment was lodged by the Council of Ministers that committed £450,000 of additional funding for the Tourism Development Fund.  It was proposed that this could be funded within existing spending limits

During the debate of the draft Annual Business Plan 2012 this commitment was restated by the Chief Minister and Minister for Treasury and Resources. The States accepted Senator Le Gresley’s request to withdraw his Amendment (P123/2011 Amd (3)) on the basis of this commitment.

Proposal

The Treasurer of the States has agreed to the transfer of £450,000 from the Central Reserve (TR-2011-DD113) to the Economic Development Department. It is recommended that the Minister accepts this on the basis that it will be awarded as an onward grant to the Tourism Development Fund. This decision does not change the total amount of expenditure approved by the States for 2011.

Resource implications

This grant to the Tourism Development Fund will bring the total amount in the Fund to around £700,000. There are no manpower implications.
