Jersey International Finance Centre: Procurement Process: Buildings 1, 4, and Underground Car Park

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Shareholder approval for the States of Jersey Development Company (“SOJDC”) to vary the procurement process for buildings numbered 1, 4 and the underground car park for the Jersey International Finance Centre (“JIFC”).

Decision(s):

The Assistant Minister decided the following in accordance with MoU 5.1, which allows for some modifications to the MoU from time to time by agreement between the parties:-

  • To approve an adaptation of the traditional procurement methods as defined under the Memorandum of Understanding (MoU) 17.1 and adopt a two stage design and build procurement process for the construction of JIFC numbers 1 and 4 and the underground car park.
  • Under MoU 13.1, the Minister provides consent, before the company enters into any material contract for either or both buildings, that a main contractor be appointed for stage one (pre-contract phase) and subject to their satisfactory performance and price, they will be appointed by SOJDC for the second stage (construction contract) on a design and build  fixed price contract basis.

Reason(s) for Decision:  

The Jersey International Finance Centre (phase 1 of the Esplanade Quarter Masterplan) is planned to comprise six individual buildings. The first building proposed to be constructed is building 1 subject to a pre-let, which will include the construction of an underground car park. Building 4 construction will commence once there is a sufficient level of legally binding pre-lets.

 

 The Minister is required to give his approval before SOJDC enters into a material contract in accordance with MoU 13.1.

 

A two stage design and build process for these buildings will provide SOJDC operational agility and accelerate the traditional procurement strategy by achieving some design and construction overlaps. A two stage design and build contract is a standard tried and tested form of contract in the construction industry.

Action required:

In accordance with Projet P.73/2010, section 12 of the report, this decision will not take effect for 15 days from the date of signing.
