Jersey Architecture Commission: Appointment of new commissioners and membership and update of Terms of Reference

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

and on call for advice (viability)

  1. John Desmond
  1. appointments listed at 3.(a) to (i) to run for a further three years from March 2019until March 2022; and
  2. Uupdated the 2018 Terms of Reference.

Reason(s) for Decision:

  1. The provision of specialist knowledge, of both sustainability and landscape, within the JAC has become increasingly important reflecting the wide range of projects reviewed by the Commission; and the significance of these issues relative to the need to address the challenges of climate change.
  2. Following the retirement of Melanie Dodd from the JAC in 2019 the Commission has been operating with limited numbers. It is proposed to increase the number of commissioners, from 10 to 15, will serve to widen the skill set of the JAC; and help to manage the draw on individual’s time as the scope of work increases. The appointment of the three additional commissioners outlined above helps to realise this objective.
  3. The composition of the JAC and the continued service of commissioners was considered and endorsed by the Minister in March 2019 and its formalisation seeksformal endorsement will to enable the continuation of the Commission’s work, based on the current membership, until March 2022.
  4.  The updated Terms of Reference 2018 will be updated to reflect the changes to the numbers of Commissioners, skill sets and the process of future reviews,

Resource Implications:

  1. The costs associated with running the JAC are met from within existing budgets;
  2. There are no legal implications arising from this decision: the JAC operate in an entirely advisory capacity.

Action required:

  1. To formally invite Lynne Sullivan, Chris Twinn and Johanna Gibbons to join the JAC as commissioners on the basis of a three-year term, commencing September 2020;
  2. To formally confirm the re-appointment of the serving 10 commissioners as set out above;
  3. Update the Terms of Reference 2018 and publish these on the Government of Jersey website.
