A Migration Policy for Jersey Part 2 - Managing Access to Employment and Housing.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A Migration Policy for Jersey Part 2 - Managing Access to Employment and Housing

Decision(s):  The Chief Minister agreed to present the Consultation Paper on Part 2 of the Migration Policy for Jersey - Managing Access to Employment and Housing - on behalf of the Migration Advisory Group.

Reason(s) for Decision: The Migration Policy was approved in 2005 and is a key strategy of the States Strategic Plan 2006 -2011. Its approval was followed in 2006 by the establishment of the Migration Advisory Group, the formation of the Population Office, and the development of a single regime to manage housing consents and business licensing. Concurrently, the development of the new Laws has taken place in two phases:  

  • Managing Migration : New Mechanisms Part 1  proposed the creation of a Population Register to record accurately the name and address of all Island residents, as a means of managing migration, and to improve customer service across the States. The policy also proposed a registration card for all residents for Social Security purposes and to access housing and employment, and a ‘first-stop-shop’ where newcomers to Jersey could obtain their card and find out more about life in Jersey. These proposals formed the basis of a public consultation in December 2007.

 

  • Managing Migration: New Mechanisms, Part 2:

 

These proposals set out in detail mechanisms to replace the existing Housing and Regulation of Undertakings and Development Laws which govern access to employment and housing, with new unified controls. This will effectively manage how many people can work in Jersey and how accommodation can be occupied and owned. This in turn will effectively regulate migration, and protect local housing and employment opportunities, while supporting economic growth and diversity.  

This Part 2 Consultation paper includes as an appendix copies of the draft Register of Names and Addresses (Jersey) Law 200- and first parts of the Migration (Jersey) Law 200- which have been drafted as a result of the Part 1 consultation process. Both laws are yet to undergo a Human Rights audit which will take place once consultation on Part 2 is complete and the final Laws drafted. However, they are included for information purposes at this stage in the interests of transparency, as comment and scrutiny are welcome.  

Following, and subject to, consultation, it is intended that Register of Names and Addresses (Jersey) Law 200- and the full Migration (Jersey) Law 200- will be lodged early in 2010, and debated by the States in mid 2010 following a lengthy lodging period. Once adopted by the States the necessary systems work will be undertaken, and it is intended to introduce the new Laws in mid 2011.

Resource Implications: The consultation process and its outcomes will form part of the ongoing work involved with the implementation of the Migration Policy.

  1. to send the Consultation Paper to the Greffier of the States and ask him to lodge it ‘au Greffe’ and present it to the States as an “R” as soon as possible, and; 
  2. Undertake other such actions as required to present the policies in the public domain.
