Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 1. The Minister accepted the recommendation of the Minister for Economic Development in respect of the following: A43B & A43C - Lease to Sutton Commercials Ltd for a term of 3 years (subject to 6 month termination should it be required for harbour development) with effect from 1 January 2010. V12M – Termination of the lease to De La Haye Fisheries with effect from 1 October 2009. Lease to P.A. & C. Gay Fisheries Ltd for a term of 9 years (subject to 6 month termination should it be required for harbour development) with effect from 1 October 2009. A32 – Lease to Maritime Catering Ltd for a term of 3 years (subject to 6 month termination should it be required for harbour development) with effect from 1 January 2010. N35 – Lease to Jersey Sailing for a term of 2 years and 1 month with effect from 1 March 2008.
Reason(s) for Decision: 1. Under Standing Order 168 (1) (a) and 168 (2) (a) and (b) the Minister hereby accepts the recommendation of a body established by the States to manage land and buildings owned by the Public of Jersey and hereby notified the States that he had accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.
Resource Implications: There are no financial or manpower implications in respect of this decision other than those detailed in the report.
Action required: 1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed. After the expiry of 15 working days following presentation to the States the transaction may be concluded. 2. The Director of Jersey Property Holdings is to pass the necessary contract and to copy this decision to the Minister for Treasury and Resources, Minister for Economic Development, Harbourmaster, Treasurer and Deputy Treasurer.
