A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Use of Le Seelleur Charitable Trust Fund to provide a grant of up to £50,000 to Age Concern Jersey to fund the procurement of a new commercial standard kitchen at the new Age Concern Jersey facility. The Ministerial Decision is seeking a grant of up to £50,000 from the Harold Ernest Le Seelleur Charitable Trust Fund to Age Concern Jersey towards the fit out commercial kitchen in the new Age Concern facility. Under the proposition P.71/97 adopted by the States on 2nd June 1997, it was decided that the administration of the Estate of H.E. Le Seelleur should be carried out by the Minister for Health and Social Services (formerly known as the Health and Social Services Committee). The grant would be commemorated by way of a plaque in memory of the Late H. E Le Seelleur as the facility will be serving the “aged, infirm and needy residents of the Island”. Purpose of the spending The grant funding would be used for the specific purpose of: Procurement of kitchen equipment to fit out a commercial standard kitchen in the new Age Concern facility that will provide meals in-house and for delivery, for the aged, infirm and needy service users of the charity Approval of the use of the Le Seelleur Charitable Trust Fund This has been proposed by the Director General of Health and Community Services. A Charitable Trust Fund committee is being set up to provide suitable governance in the future for such decisions, in the absence of this committee being in place with delegated authority a Ministerial Decision is being sought. Use of the H. E. Le Seelleur Charitable Trust Fund is in accordance with the terms of the Fund the original bequest being given to the States of Jersey for itself and its successors in perpetuity, to be used - “for the benefit of the aged, infirm and needy residents of the Island”.
Decision(s): The Minister approved the distribution of up to £50,000 grant from the H.E. Le Seelleur Fund, to Age Concern Jersey in respect of: Procurement of kitchen equipment to fit out a commercial standard kitchen in the new Age Concern facility that will provide meals in-house and for delivery, for the aged, infirm and needy service users of the charity.
Reason(s) for Decision: The distribution of up to £50,000 from the H.E. Le Seelleur Fund aligns with the purpose of the charitable trust fund, which is; “for the benefit of the aged, infirm and needy residents”.
Resource Implications: The balance on the Le Seelleur Fund will reduce by £50,000, there is no impact to the HCS revenue head of expenditure.
Action required: The drawdown of £50,000 from the Common Investment Fund. The grant for specific purpose will be distributed to Age Concern Jersey.
