Jersey Law Commission: Re-appointment of Chairman and Commissioner

A formal published ā€œMinisterial Decisionā€ is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as ā€œcorporation soleā€ under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of ā€œMinisterial Decisionsā€ is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Chief Minister approved the report and proposition proposing the re-appointment of Mr. David Lyons as Chairman of the Jersey Law Commission and of Advocate Kerry Joy Lawrence as Commissioner for a period of 5 years with effect from the date of appointment by the States.

Reason(s) for Decision:  The States, by Act dated 30th July 1996, adopted a proposition of the Legislation Committee and approved the establishment of a Jersey Law Commission.  Mr Lyons and Advocate Lawrence were appointed to the Commission in 2003 and it is now necessary to renew their memberships.

Resource Implications:  There are no resource implications.

Action required:  Request the Greffier of the States to ensure that the Report and Proposition is lodged ā€˜au Greffe’ for debate at the earliest opportunity

PROPOSITION  

THE STATES are asked to decide whether they are of opinion  -  

to refer to their Act, dated 30th July 1996, in which they approved the establishment of a Jersey Law Commission, and to re-appoint Mr. David Lyons as Chairman and Advocate Kerry Joy Lawrence as Commissioner for a period of 5 years with effect from XXXX 2009.

REPORT  

The States, by Act dated 30th July 1996, adopted a proposition of the Legislation Committee and approved the establishment of a Jersey Law Commission. On the 19th November 2003, the Commission appointed Mr Lyons as Chairman of the Commission and Advocate Lawrence as Commissioner, for a period of five years. 

The Committee is grateful to Mr. Lyons and Advocate Lawrence, who, during their term on the Commission, have been fully committed to the work they have undertaken. 

The Chief Minister therefore recommends that Mr. Lyons be appointed to serve as Chairman of the Jersey Law Commission for a period of 5 years with effect from XXXX 2009 and that Advocate Kerry Lawrence be appointed as a Commissioner also for a period of 5 years with effect from XXXXX 2009. 

There are no additional financial or manpower implications for the States arising from this proposition. 

David Lyons  

David Lyons was born in Stoke-on-Trent in 1943 and has resided in Jersey since 1973. 

He graduated from London University (The London School of Economics and Political Science) in 1965 with a LLB(Hons)(2i) degree. After lecturing in law at Kingston University he was articled in the City of London at Linklaters. He passed the Solicitors’ Finals in 1967 with a 2(i) distinction and was awarded the City of London Solicitors’ prize for the best student in the City in Commercial Law. 

After leaving Linklaters Mr. Lyons became Legal Adviser to Abbey Life and then re-entered private practice founding the firm Lyons & Caplan in Jersey in 1973 in association with Crill Cubitt Sowden & Tomes. He retired from Crill Cubitt Sowden & Tomes in 1988 but continued to practice as Lyons & Caplan whilst spending an increasing amount of time as a director of/adviser to Bilbao Vizcaya Bank (Jersey) Limited, Brown Shipley (Jersey) Limited, Bankers Trust Company Limited and The Royal Bank of Scotland (Jersey) Limited where he was Deputy Chairman until 2001. 

He has now retired from private practice and bank directorships but retains commercial interests and consultancies with several trust companies. He is a member of the International Bar Association, the International Fiscal Association and the Society of Trust and Estate Practitioners. 

Advocate Kerry Lawrence  

Advocate Lawrence is a Litigation Partner with Ogier. 

She graduated from St. Anne’s College, Oxford University with a degree in Zoology. After a career in academic publishing she re-trained in law and was called to the English Bar in 1995.  After a period at the Bar in she London came to Jersey and was called to the Jersey Bar in 1999. 

Whilst dealing in all areas of commercial litigation, her work focuses particularly on contentious trust matters, and regulatory work and she is a member of Ogier’s cross-group trust and regulatory teams.
