Jersey Gambling Commission: Charitable Gambling Consultation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Consultation exercise by the Jersey Gambling Commission (JGC) on a Code of Practice for Charitable Gambling.

Decision(s):

The Minister approved the request from the Jersey Gambling Commission to shorten the consultation period on a Code of Practice for Charitable Gambling to 14 days.

Reason(s) for Decision:

The Minister under the Gambling Commission (Consultation on Codes of Practice) (Jersey) Order 2011, Article 4(5) allows the Jersey Gambling Commission to shorten the consultation period to 14 days on account of both the work already undertaken and the need to have a Code in force for 1st January 2013. The justification for the shortened consultation period is as follows:

  • The consultation could not take place until the Draft Gambling (Charitable and Membership Gambling Services) (Jersey) Regulations 201-.had been approved by the States.
  • The JGC has already discussed the changes with the Association of Jersey Charities
  • The changes have already been in the public domain for nearly two weeks within our pre-consultation document
  • The changes are largely beneficial to charities, clubs and societies who will (with the exception of 3) have their fees and paperwork reduced (& even those 3 will see reductions in their other activities)
  • No charity will be able to hold lawful gambling until such time as the Code is adopted and that needs to be before 1st January.

 

Resource Implications:

There are no financial or manpower implications for the States.

Action required:

Strategy Manager to communicate the decision to the Jersey Gambling Commission at the earliest opportunity.
