Nursery Funding: Implementation of proposed changes (P39/2016): Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the amendment to Proposition 39 / 2016 and accompanying report and instructed the Chief Officer to arrange for the amendment to be lodged au Greffe before 3 May, for the scheduled debate on 10 May 2016.

Reason(s) for Decision: To enable the Minister to consider the findings and recommendations of the Scrutiny review concerning Nursery Education (to be presented to the States Assembly), prior to the lodging of the Medium Term Financial Plan on 28 June 2016.

 

Resource Implications: There are no resource implications with regard to this amendment being lodged au Greffe.

Amendment

 

  1. In paragraph (a) after the words ‘States Assembly’ insert the words ‘by 14th June 2016’.

 

Report

 

The amendment to Proposition 39/2016 will enable the Minister for Education to consider the findings and recommendations of the Scrutiny review prior to the lodging of the Medium Financial Plan on 28 June 2016.

 

The Proposition asks the States to decide whether they are of opinion:

 

to request the Minister for Education not to implement proposed changes to Nursery Funding until such time as –

 

(a)   the Education and Home Affairs Scrutiny Panel has fully reviewed the issue and presented its findings and recommendations to the States Assembly; and

 

(b)   the States has considered and endorsed the Minister’s proposals.

 

 

This amendment will enable the Minister to consider the findings and recommendations of the Scrutiny review, which will be presented to the States Assembly, prior to the lodging of the Medium Term Financial Plan on 28 June 2016.

 

States members will then have the opportunity to consider and endorse the Minister’s proposals at during the Medium Term Financial Plan debate on 27 September 2016.
