Transport and Technical Services: Fees and Charges: 2014 Increases (excluding Jersey Car Parks)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transport and Technical Services – 2014 Departmental Increases to Fees and Charges (excluding Jersey Car Parks)

 

Decision(s):  The Minister approved the increases to the Department’s fees and charges as set out in the attached schedule, and requested permission from the Minister for Treasury & Resources to increase  above RPI(X) as at September 2013 in order to meet the income obligation set out in the Medium Term Financial Plan 2013-2015.

 

Reason(s) for Decision:  To enable the Department to increase its fees and charges by 2.5% from 01 January 2014 in line with the increased income assumptions as per the Medium Term Financial Plan 2013-2015 in order to meet cash limits and ensure cost recovery and to approve the revised schedule of charges in respect of contaminated material and plasterboard (from 07 April 2014) and inert waste (from 01 July 2014)

This Ministerial Decision excludes the charges for Jersey Car Parks which will be under a separate Ministerial Decision.

 

Resource Implications:  The additional income as a result of the proposed increases to fees and charges has been included within the income estimates in the Medium Term Financial Plan for 2013-2015.  The cost of advertising increases to fees and charges in the Jersey Evening Post.

 

Action required:  Request permission from the Minister for Treasury and Resources and when approved the Finance Director to arrange for the Department’s fees and charges to be advertised in the Jersey Evening Post.
