Budget transfer from Restructuring Provision to Home Affairs to deliver Comprehensive Spending Review 2012 proposals

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Allocation of funds from the Restructuring Provision to Home Affairs to achieve a 2012 CSR savings proposal.

Decision(s):  The Minister approved a budget transfer of £68,300 from the Restructuring Provision to the Home Affairs Department to deliver a CSR proposal in 2012 by accepting two voluntary redundancy applications.

Reason(s) for Decision: 

(a)   This request for funding has a pay back of less than 8 months, well within the 2 years set down for VR payments in the CSR process.

(b)   The request is considered as urgent given that members of staff are involved and appropriate notice is required to be given.

(c)   Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Resource Implications:  The 2012 balance on the Restructuring Provision after this request is £5,705,800. This decision does not change the total amount of expenditure approved by the States for 2012.

Action required:  Head of Decision Support to notify the Comprehensive Spending Review Team Leader and Head of Financial Performance reporting that this decision has been approved.
