Road traffic orders relating to St. Thomas' residents parking zone

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002

Decision(s):   The Minister made the Road Traffic (St Helier) (Amendment No.2) (Jersey) Order 2010, and Road Traffic (Disabled Persons) (Parking) (Amendment) (Jersey) Order 2010, to become effective on 13 January 2010, the purpose of which is to implement the new St Thomas’ Residents Parking Zone.

Reason(s) for Decision:  At the request of the Connétable to amend the Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

Resource Implications:   Transport and Technical Services time.

Action Required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (ST HELIER) (JERSEY) ORDER 1996 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2002 – AMENDMENTS  
 

Purpose of the Report  

To implement the new St Thomas’ Residents Parking Zone. 
 

Background  

On 07 August 2009 the Minister for Transport and Technical Services approved the above Parish request under Ministerial Decision MD-T-2009-0074, and instructed the Law Draftsman to draft the necessary Order Amendments. 
 

Discussion  

Parish Officers drew up the proposed zoning and consulted widely with residents and businesses in the area. The scheme reduces the number of available paycard spaces in predominantly residential areas to allow for more Residents Parking Zone permits to be issued but it does provide an adequate number of paycard parking areas for people visiting the area.  

This will be the fourth Residents Parking Zone within St Helier, the others being Stopford Road, Cheapside and Richmond Road. 

TTS supports the introduction of this Residents Parking Zone with the Parish of St Helier taking responsibility for the enforcement and administration of the zone, as is currently the arrangement with the existing Residents Parking Zones. 
 

Recommendation  

The Minister is recommended to approve the Amendments to become effective from the 13 January 2010.
