Treasurer of the States: Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The appointment of Richard Bell to carry out the functions of the office of Treasurer of the States.

Decision(s): The Minister decided:

  • to appoint Mr Richard Bell to the position of Treasurer of the States to carry out the functions of the office of Treasurer of the States. Following the successful application and acceptance by Mr Richard Bell of the role of Treasurer of the States, the Minister has made this appointment with effect from 15th January 2015.
  • To appoint Richard Bell as Accounting Officer for the Treasury and Resources Department and those special and trust funds for which the previous Treasurer, Ms Rowley had Accounting Officer responsibility. 

Reason(s) for Decision: The Public Finances (Jersey) Law 2005 establishes the office of Treasurer, Article 29 (1) of the law allows the Minister to appoint a person to carry out the functions of the office of Treasurer of the States. Following the resignation of Ms Laura Rowley, Mr Richard Bell was appointed Interim Treasurer, effective from 11th August 2014, to fulfil the functions of the office of Treasurer of the States until a permanent replacement was appointed. Following the successful application and acceptance by Mr Richard Bell of the role of Treasurer of the States the Minister has made this appointment with effect from 15th January 2015.

 

Articles 37 and 38 of the Law deal with the role of Accounting Officer. The Minister for Treasury and Resources is asked to confirm that Richard Bell take over Accounting Officer responsibilities for those areas held by the previous Treasurer of the States, Ms Rowley.

Resource Implications: The budget, headcount and establishment for the post of Treasurer of the States are already in existence and therefore there are no additional resource implications.

Action required: Mr Richard Bell to carry out the functions of the office of Treasurer of the States and to be appointed as Accounting Officer for the Treasury and Resources department and associated special and trust funds.

Appointment of Treasurer OF THE STATES

 

  1. Purpose of Report

The appointment of Richard Bell to carry out the functions of the office of Treasurer of the States and to take on the role of Accounting Officer for the Treasury and Resources Department and the special and trust funds for which Ms Rowley previously had Accounting Officer responsibility.

 

  1. Background

Laura Rowley, the Treasurer of the States resigned from her post effective from 11th August 2014. Mr Richard Bell had been appointed Interim Treasurer of the States effective from 11th August 2014, to fulfil the functions of the office of Treasurer of the States until a permanent replacement was appointed. Mr Richard Bell has been successful in his application to continue on a permanent basis.

 

Mr Richard Bell has extensive experience having held the Chief Officer role at Social Security and previously served as Deputy Treasurer of the States.

 

  1. Recommendation

The Minister is recommended to appoint Mr Richard Bell as:-

  •  the Treasurer of the States, the person appointed to carry out the functions of the office of Treasurer of the States; and
  •  Accounting Officer for the Treasury and Resources Department and of the special and trust funds which the previous Treasurer of the States, Ms Rowley held Accounting Officer responsibility.
