Disciplinary and Grievance Code of Practice Revised

The “Disciplinary and Grievance Practice and Procedures” code of practice has been revised by the Social Security Minister, Senator Routier, in preparation for an amendment to the Employment ( Jersey ) Law, 2003, which will come into force within the next few months, subject to Privy Council approval.

Earlier this year, the States approved an amendment which will give employees the right to be represented by a fellow employee or trade union official in formal disciplinary and grievance hearings.

The Disciplinary and Grievance code of practice was first issued in July 2005 under the Jersey Advisory and Conciliation ( Jersey ) Law, 2003, but the code must now be amended to reflect the new right to representation.

Senator Routier said, “A revised draft of the code has been prepared and I invite any member of the public who may be affected to send me their comments on the revisions that have been made regarding this right, as set out in Section 3 of the code. Sections one and two of the code are already in force and I understand that they are working well.”

Written representations are invited from the public during the period 29 May to 26 June. The Social Security Minister will then consider any comments received before approving a final draft of the code, which will come into force on the same date as the amendment to the Employment Law.
