Responses to consultation paper on non-profit organisations published

Today, a summary of the responses to the consultation paper on The Registration and Monitoring of Non-Profit Organisations is being published.

The consultation paper prompted considerable written and oral feedback – over 38 responses were received from 46 organisations and individuals.  All have been carefully considered and changes made to the draft law as a consequence.  A current draft of the law is attached to the feedback paper.

This legislation has been drawn up in response to recommendations by the Financial Action Task Force concerning international efforts to combat the financing of terrorism. These will be reviewed as part of the visit by the IMF later this year.

Welcoming the interest shown in the consultation, the Chief Minister, Senator Frank Walker, said:  “I recognise that there has been significant time pressure, so I thank everyone for their prompt and valued contributions to the debate.  I look forward to further discussion with those attending the public meeting.”

A public meeting to discuss any outstanding issues on the draft NPO law is being held at 5.30pm on Thursday 10 April at St Paul’s Centre.

Notes to editors

1. The consultation feedback has been published by the Island’s AML/CFT Strategy Group.  This group comprises representatives from a number of government departments and the Jersey Financial Services Commission.

2. The FATF is the inter-governmental body responsible for setting international standards for combating money laundering and the financing of terrorism.

3. The definition of a non-profit organization has been amended such that: “NPO means a body of persons (whether incorporated or unincorporated), any legal entity and any equivalent or similar structure or arrangement and includes persons acting as trustees of a trust, that is established solely or primarily for charitable, religious, cultural, educational, social or fraternal purposes with the intention of benefiting its members or the public or a section of the public and it raises or disburses funds in pursuance of those purposes.”​​
