Bellozanne covenants issue resolved

A legal issue in relation to the Bellozanne site has been resolved as the covenants on the site have been declared spent and extinguished.

When the Bellozanne site, including three waste destructors, was sold by the Parish of St Helier (POSH) to the Public of the Island in 1952, covenants were included, some focussing on how and what waste should be received at Bellozanne. It had been uncertain as to if or how this covenant impacted current day waste operations and whether it inhibited charging for waste disposal.

Minister for Infrastructure, Deputy Eddie Noel, said “I am pleased that the Bellozanne covenants issue has at last been resolved. There has been a cloud of uncertainty over the covenants’ implications on waste operations for a number of years. This resolution gives us a clearer way forward.”

​The Royal Court issued a final judgment on the matter today, 2 September 2016.
