A

The number of Freedom of Information Requests to Scheduled Public Authorities which have taken longer than the required response time of 20 working days in order to produce a full response, and if possible the length of time taken in individual cases.

B

And how many if any of these requests have taken longer than the maximum period of prescribed maximum period of 65 working days?

C

How many of those requests in questions A and B have been the subject of complaints to the Commissioner by the requesting party?

D

The results of any complaints made.

E

The numbers of any pending unresolved complaints.

F

Whether the FOI Department has referred of its own volition any response issues to the Commissioner?

G

Whether any response audits have taken place either initiated by the FOI Department or by the Commissioner and the results thereof if carried out.

A

Out of 749 responses issued from 1 January 2022 to 28 February 2023, 225 took longer than 20 days, as permitted by Regulations.

Information about the length of time taken in individual cases would require manipulation and creation of data. The Freedom of Information (Jersey) Law 2011 does not require a Scheduled Public Authority to manipulate or create data in order to provide a response.

Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

No responses were the subject of an appeal to the Office of the Information Commissioner due to them exceeding 20 working days.

There is one appeal that is currently awaiting a decision by the Office of the Information Commissioner.

No referrals have been made to the Commissioner.

No response audits have been undertaken; however, response times are regularly monitored.

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority
