The Basel Convention on the control of Trans-boundary movements of Hazardous & Toxic Wastes and their disposal came into effect in 1992, the UK Government is a member.

The UK government reaffirmed on 14 September 2007 that it represented Jersey.

Is there any current Jersey law or legislation that prevents or precludes Jersey from utilising the provisions of the Convention, either between 1992 and 2007, or between 2007 and the present day?

​It is noted that the ongoing export from Jersey to the UK of incinerator 'fly ash' appears to comply with the Convention.

Response

In 2007, the Basel Convention (the ‘Convention’) was extended to Jersey through a United Kingdom Government ratification, therefore, the provisions of the Convention were applicable to Jersey.  

The Convention was implemented through the Waste Management (Jersey) Law 2005, which is the legislation that requires Jersey to follow the requirements of the Convention.  

Prior to 2007, Jersey followed the UK’s requirements regarding any exports of waste from Jersey to the UK, including hazardous and toxic waste since the UK was a signatory to the Convention. ​
