Deputy Chief Officer, States of Jersey Police - Resignation Statement to States Assembly and withdrawal of P.30/2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Resignation of the Deputy Chief Officer, States of Jersey Police, approval of the wording of the statement to the States Assembly, withdrawal of P.30/2010 and the need to recommence the appointment process.

Decision(s): The Minister accepted the resignation of the Deputy Chief Officer, States of Jersey Police, with effect from 31 December 2010; requested the withdrawal of P.30/2010, which relates to the appointment of the Chief Officer, States of Jersey Police; approved the Statement to be made to the States Assembly regarding the decision by the Deputy Chief Officer, States of Jersey Police not to be further considered for the post of Chief Officer, States of Jersey Police and decided to commence the appointment process to find a new Chief Officer, States of Jersey Police. 

Reason(s) for Decision: The States are responsible for appointing the Chief Officer, States of Jersey Police.  It is therefore appropriate that the States should be informed of the decision of the Deputy Chief Officer, States of Jersey Police, to resign as they were due to debate P.30/2010 (the appointment of the Deputy Chief Officer to the role of Chief Officer) in September 2010.  Following the resignation of the Deputy Chief Officer, States of Jersey Police, the proposition relating to his appointment as Chief Officer, falls away.  The Deputy Chief Officer, States of Jersey Police, will leave the post at the end of December 2010 and a recruitment process to find a new Chief Officer, involving the Appointments Commission should commence as soon as possible.

 

Resource Implications: There will be some costs associated with the recruitment process.

Action required: The Executive Officer, Home Affairs, to progress the Ministerial Decision.
