Vauxhall House, 5 Vauxhall Street, St. Helier: List as Grade 4

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to;

  1. List Vauxhall House, 5 Vauxhall Street, St Helier;
  2. Assign a non-statutory grade 4 to it.

Reason(s) for decision:

  1. some of the representations received in relation to this property relating to potential future change; maintenance liabilities; and the availability or otherwise of grant aid; are not, in light of the Court of Appeal judgement [2013]JCA237, material; and
  2. notwithstanding those elements of the representation which remain valid and which have been duly taken into account resulting, where recent physical change to the building has been highlighted, in amendment to the Listing description, the special interest of Vauxhall House, 5 Vauxhall Street, St Helier as set out in the schedule and relative to the published criteria for selection, justifies its Listing in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 in particular because;
    1. this neo-classical style house has sufficient external architectural interest in its own right, including original 12 pane sash windows with shutter hinges on the building frontage; a fine pedimented doorcase with a frieze, (replacement) pilasters and glazed overlight featuring VAUXHALL HOUSE; together with low wall with granite copings and cast iron railings and gate;
    2. this 1830/40s house is of historical interest in its own right and together with other historic buildings in both Vauxhall Street and Duhamel Place, contributes to the historic townscape value of this part of St Helier.
  3. the interior of the house is not included in the Listing as there is insufficient survival of original fixtures and fittings.

Legal and resource implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 requires the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.

  2. Update the List
