Budget transfer from General Reserve Funding to Office of the Chief Executive: Pilot Schemes

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The allocation of £1,000,000 for the Provision for Pilot schemes within the General Reserve head of expenditure to the Office of the Chief Executive in 2020. 

Decision(s):

The Minister approved an allocation of £1,000,000 for the Provision for Pilot schemes within the General Reserve head of expenditure to the Office of the Chief Executive in 2020. 

Reason(s) for Decision: 

Article 15(3) of the Public Finances (Jersey) Law 2019 states that the approval by the States of a government plan authorises the Minister to direct how an approved appropriation for a reserve head of expenditure in the plan may be spent (including on another head of expenditure) in the first financial year covered by the plan.

 

The Government Plan 2020-2023 includes £1,000,000 within the General Reserve to fund new ideas and solutions to be developed across government. Innovation requires an ability to move at pace, and an associated source of funding that is capable of being deployed in an appropriately rigorous and agile way. Accordingly, the Minister is allocating the £1,000,000 Provision for Pilot Schemes in the General Reserve to the Office of the Chief Executive to be used for the above purpose, and for other priorities as determined by the Chief Minister, under the direction and good governance of the Chief Minister.

Resource Implications:

The General Reserve head of expenditure to decrease by £1,000,000 in 2020 and the Office of the Chief Executive revenue head of expenditure to increase by the identical amount.

 

This decision does not change the total amount of expenditure approved by the States in the Government Plan 2020-2023.

Action required: The Head of Financial Governance to advise the Specialist – Business Cases and the Head of Finance Business Partnering of the receiving department that this decision is approved.
