Employment Tribunal (Amendment No. 2) (Jersey) Regulations 200-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Lodge Employment Tribunal (Amendment No. 2) (Jersey) Regulations 200-

Decision(s): The Minister decided that the Employment Tribunal (Amendment No. 2) (Jersey) Regulations 200- should be lodged to enable the making of Ministerial Orders which would increase the daily sitting rates for the Members of the Employment Tribunal.

Reason(s) for Decision: The States approved in 2007 that the Employment Law should be amended to allow the daily sitting rates for the Chairman, Deputy Chair and Side Members of the Employment Tribunal to be set by Ministerial Order rather than Regulations, subject to a minor amendment to the Employment Tribunal (Jersey) Regulations 2005. The current rates of remuneration for the Tribunal members have applied since 1 November 2006; £736 for the Chairman, £552 for the Deputy Chairman and £97 for Side Members.

Subject to States approval of that amendment, the Minister intends to make an Order increasing the Chairman’s daily sitting rate to £774.  This represents an increase of 5.163 percent in a period of more than two years.  The 5.163 percent increase will also be applied to the Deputy Chairman’s rate resulting in a daily sitting rate of £580.50 and for the Side Members a new daily rate of £102.01. The revised rates will be effective from the date on which the Ministerial Order is made. 

Resource Implications: As the increase is unlikely to be effective until 2009, there are no resource implications for 2008. It is estimated that the increase will result in an additional cost of approximately £2,500 for 2009.

Action required: Kate Morel to request that the Greffe lodges the Proposition to be presented to the States at the earliest opportunity.
