Transfer of underspend from Victoria College capital project to Education Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Return of any underspend on the Victoria College capital project to build a new classroom block to the Education Department Minor Capital head of expenditure.

Decision(s): The Minister for Education approved the transfer of any underspend on the forthcoming capital project at Victoria College to replace the porta cabins on College Fields with a new classroom block, up to a maximum of £567,950 as a proportion of the total budget for the project, from the Victoria College Extension capital head of expenditure (FA0MD09002) within the Department for Infrastructure to the Education Minor Capital head of expenditure (E00MC10003) 

Reason(s) for Decision: Ministerial Decision MD-ESC-2016-0025 approved a budget transfer of £567,950 from the Education Department to the Department of Infrastructure to fund capital works at Victoria College, namely the replacement of porta cabins at College Field with a much needed new classroom block. Funding for the capital project had been raised from school fee increases over the past few years (£405,000) and from funds previously allocated for the development of Francis Field (£162,950), a project which is presently on hold. The new classroom block is not expected to require funds from any other source. 

 

Any underspends on the capital project relating to funding from school fees should be returned to the Education Department for use on future Victoria College capital projects. Additionally any underspend on the project relating to funding from Francis Field should also be returned to the Education Department to replenish this budget for the future development of Francis Field for school use.

 

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

Resource Implications: The Department for Infrastructure capital head of expenditure (FA0MD09002 Victoria College Extension) to decrease by the amount remaining unspent at the end of the project, up to £567,950, and the Education Department minor capital head of expenditure (E00MC10003) to increase by an identical amount.

Action required: The Minister for Education to seek approval of the Treasurer of the States for the return of any underspend on this capital project.
