Budget Transfer from Restructuring Provision for Taxes Office Modernisation Programme

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The transfer of £1,315,500 from the Restructuring Provision to the Treasury and Resources Department revenue head of expenditure to fund the Taxes Office Modernisation Programme (TOMP) to be allocated in annual tranches of £438,500 for 2017, 2018 and 2019.  The extension of 4.0 FTE and an increase of 1.0 FTE within the Treasury and Resources Taxes Office TOMP for the period 1st January 2017 to 31st December 2019 to be funded by the transfer request.

Decision(s):

The Treasury and Resources Minister approved  one off budget transfers of £438,500 in 2017, 2018 and 2019 from the Restructuring Provision to the Treasury and Resources Department (Taxes Office) in order to continue the TOMP work and the extension of 4.0 FTE and increase of 1.0 FTE within the Treasury and Resources Taxes Office for the period 1 January 2017 to 31 December 2019.

Reason(s) for Decision:

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers and this restructuring provision bid was approved at their meeting on 7th December 2016.

 

To comply with P67/1999 which charges the Minister for Treasury and Resources to regulate the number of persons that may be employed by the States and delegation 2.3 in which authority is delegated to the Treasurer of the States for agreeing non-contentious increases to States staffing levels.

 

The Council of Ministers approved the required funding, as outlined in the TOMP PSR Business Case, from the Restructuring Provision in their meeting of 7th December 2016. 

 

Resource Implications:

The Treasury and Resources revenue head of expenditure to increase by £438,500 for each of the years 2017, 2018 and 2019 and the Restructuring Provision, held within Central Contingencies, to decrease by the same amount in the corresponding years.  This decision does not change the total amount of expenditure approved by the States in the Medium Term Financial Plan 2016 to 2019.

 

A temporary extension to 4.0 FTE from 1st January 2017 until 31st December 2019 relating to TOMP and a temporary increase of 1.0 FTE in the Treasury and Resources Taxes Office for the period 1st January 2017 to 31st December 2019 for the Programme Director post, increasing the total FTE in Treasury and Resources from 205.9 to 206.9 (5.0 FTE to be removed 1st January 2020). These are all funded by the transfer from the Restructuring Provision.

 

Action required:

The Head of Decision Support to advise the Finance Director of the Corporate Group that this decision is approved.
