Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012.

Decision(s): The Minister made the Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012.

 

Reason(s) for Decision: On 19 December 2012 the Minister made a Ministerial Decision (MD-HA-2012-0086) agreeing to increase the fee payable for the issue of a fire certificate.  The Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012 gives effect to that decision.

 

Resource Implications: Additional income will be raised by the introduction of the increase in charges.  This is in line with the principle of ‘user pays’, which was approved by the States and will enable the States of Jersey Fire and Rescue Service to recover the costs associated with the issuing of fire certificates.

 

Action required: The Executive Officer, Home Affairs, to inform the Publications Editor at the States Greffe that the Order has been made and to request the Greffier of the States to arrange for the making of the Order to be notified to the States.

Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012

 

On 19 December 2012 the Minister made Ministerial Decision (MD-HA-2012-0086) to increase the level of fee payable for the issue of a fire certificate under the Fire Precautions (Fees) (Jersey) Order 2010. 

The increase in the level of fee ranges from 2% to 2.9% in order to enable the fees to be ‘rounded’ either up or down to the nearest 1p where the fees are payable per square metre and to the nearest pound in other cases.  This assists in the administration of the charges.  As some of the increases exceed 2.5%, the approval of the Treasurer, under delegated authority from the Minister for Treasury and Resources, was obtained.

The new Order will come into force on 1 January 2013.

Recommendation

It is recommended that the Minister makes the Fire Precautions (Fees) (Amendment No.2) (Jersey) Order 2012 and requests the Executive Officer, Home Affairs, to request the Greffier of the States to arrange for the making of the Order to be notified to the States.
