Budget transfer from Restructuring Provision to Community and Constitutional Affairs Department: Medical Practitioners Register (Health and Social Care Professionals Register)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Qualified Exempt, Article 35 Freedom of Information Jersey) Law 2011

Subject:

The allocation of up to £170,000 in 2017 from the Restructuring Provision to the Community and Constitutional Affairs minor capital head of expenditure to fund the Medical Practitioners Register (Health and Social Care Professionals Register).

Decision(s):

The Minister approved the allocation of up to £170,000 in 2017 from the Restructuring Provision to the Community and Constitutional Affairs minor capital head of expenditure to fund the Medical Practitioners Register (Health and Social Care Professionals Register).

Reason(s) for Decision:

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers and this restructuring provision bid was approved at their meeting on 6th July 2016.

The transfer of a range of Public Health functions to the Department for Community and Constitutional Affairs was approved by the Chief Minister on 31 March 2017 (MD-C-2017-0041) and the Minister for Treasury and Resources on 12th May 2017 (MD-TR-2017-0055).

MD-C-2017-0084 was signed by the Chief Minister on 23rd June 2017.

Resource Implications:

The Community and Constitutional Affairs minor capital head of expenditure to increase by up to £170,000 in 2017 and the Restructuring Provision to reduce by an identical amount.

This decision does not change the total amount of expenditure approved by the States for 2017 in the Medium Term Financial Plan.

Action required:

The Head of Decision Support to advise the Finance Director, Community and Constitutional Affairs that this decision is approved.
