Criminal Offences Confiscation Fund: Application for Funding/Budget Transfers: Police Headquarters Re-location

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The application of funding of £1,800,677 from the Criminal Offences Confiscation Fund (COCF) to the Home Affairs Department (HAD) for the Police Headquarters relocation capital project for which this funding was approved.

Decision(s): The Minister approved the following:

  •     an application for funding of £1,800,677 from the COCF to the HAD to fund specialist equipment and facilities for the Police Headquarters relocation capital project;
  •     the use of additional income of £1,800,677 by HAD;
  • a non-recurring budget transfer in 2014 of £1,800,677 from the HAD revenue head of expenditure to the Treasury and Resources (T&R) (Jersey Property holdings (JPH)) Police Relocation capital head of expenditure. 

Reason(s) for Decision: Article 19(1)(a) of the Public Finances (Jersey) Law 2005 states that if, during a financial year, the Minister is satisfied that the income of a States funded body is likely to exceed its estimated income, the Minister may authorise the body to withdraw from the consolidated fund during that year an amount not exceeding the likely excess of income.

 

Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

The application identifies a number of specific security features and specialist equipment to assist in safeguarding the security and integrity of the criminal justice process and in the prevention and detection of crime and criminality which meet the criteria for consideration of funding from the COCF.

 

In a letter to the Treasurer, dated 20th March 2014, the Attorney General has confirmed his support for the use of COCF funds for this purpose.

 

The Council of Ministers in their meeting of the 9th April 2014, also endorsed the proposal of the Minister for Treasury and Resources to approve this funding.

 

Resource Implications: Once the HAD income target budget and the HAD revenue head of expenditure have been increased by £1,800,677, that sum will subsequently be transferred from the HAD revenue head of expenditure to the T&R (JPH) Police Relocation capital head of expenditure. This decision does not change the total amount of expenditure approved by the States.

Action required: Head of Decision Support to notify the Assistant Accountant, Financial Performance Reporting Manager and the Finance Director – Home Affairs that this decision has been approved.
