Budget transfer from Restructuring Provision to Community and Constitutional Affairs: Police Mobile Technology Project

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  A non-recurring budget transfer of £672,146 across the years 2017 and 2018 from the Restructuring Provision held within Contingency to the Community and Constitutional Affairs minor capital head of expenditure to fund the States of Jersey Police Mobile Technology Project (SMARTPolice).

 

In addition the Minister is requested to approve the non-recurring budget transfer of £548,000 from the Community and Constitutional Affairs revenue head of expenditure, previously approved in Ministerial Decision MD-TR-2016-0037, to the Community and Constitutional Affairs minor capital head of expenditure.

Decision(s): The Minister decided to approve a non-recurring revenue budget transfer of £672,146 across the years 2017 and 2018 from the Restructuring Provision held within Contingency to the Community and Constitutional Affairs minor capital head of expenditure to fund the States of Jersey Police Mobile Technology Project (SMARTPolice).

 

In addition the Minister approved the non-recurring budget transfer of £548,000 from the Community and Constitutional Affairs revenue head of expenditure, previously approved in Ministerial Decision MD-TR-2016-0037, to the Community and Constitutional Affairs minor capital head of expenditure.

Reason(s) for Decision:   

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers.

 

On the 9th December 2015 the Council of Ministers approved the States of Jersey Police bid of £1,445,000 from the Restructuring Provision for the Mobile Technology Project (SMARTPolice). The Council agreed funding of up to £773,000 in 2016 and “in principle” the request for funding of £529,800 in 2017 and £142,200 in 2018.  

At a subsequent Council of Ministers meeting on 8th February 2017 a funding request for £672,146 (being £529,823 in 2017 and £142,323 in 2018) was approved. The £672,146 is part of the total funding allocation of £1,445,000 for Mobile Technology Project (SMARTPolice) as approved by COM in December 2015.

 

Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

In Ministerial Decision MD-TR-2016-0037 signed on 3rd May 2016 a non-recurring budget transfer of £773,000 in 2016 was approved from the Restructuring Provision held within Contingency to the Community and Constitutional Affairs revenue head of expenditure.  Permission is now being requested by the Community and Constitutional Affairs Department for the non-recurring budget transfer of £548,000 from the Community and Constitutional Affairs revenue head of expenditure to the Community and Constitutional Affairs minor capital head of expenditure.

Resource Implications:

This decision will result in the Community and Constitutional Affairs minor capital head of expenditure increasing by £672,146 across 2017 and 2018 and the Restructuring Provision, held within Contingency, to decrease by an identical amount.

The £672,146 in total is proposed to be drawn down across the years 2017 and 2018 as £529,823 in 2017 and £142,323 in 2018. The amount for each year may be varied without exceeding the total amount for the two years.

This decision does not change the total amount of expenditure approved by the States for 2017 and 2018 in the Medium Term Financial Plan.

 

In addition the Community and Constitutional Affairs revenue head of expenditure will decrease by £548,000 in 2017 and the Community and Constitutional Affairs minor capital head of expenditure will increase by an identical amount.

Action required: The Head of Decision Support to advise the Finance Director, Community and Constitutional Affairs once this decision has been approved.
