Department for Infrastructure (Driver and Vehicles Standards - 2019 Fees) (Jersey) Order 2018

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Infrastructure (Driver and Vehicle Standards – 2019 Fees) (Jersey) Order 2018.

Decision(s): The Minister made the Infrastructure (Driver and Vehicle Standards – 2019 Fees) (Jersey) Order 2018 which will increase fees for services provided at DVS and the fee for Compulsory Basic Training, from 01 January 2019.

 

Reason(s) for Decision:  To enable DVS to increase its fees and charges from 1 January 2019 in order to meet cash limits and aid towards cost recover, in line with MD-T-2018-0066.

 

Resource Implications:  The additional income as a result of the increases to fees and charges will enable DVS to meet cash limits and aid towards cost recovery.

 

Action required: To notify the Publications Editor and the Law Draftsman that the Order has been made; forward the signed and sealed Order to the Publications Editor, States Greffe; and request the Greffier of the States to arrange for its notification to the States.

 

Head of Driver and Vehicle Standards to arrange to publish details of the Order and request the Department to revise the fees displayed on the States website and introduce the fees accordingly.

INFRASTRUCTURE (DRIVER AND VEHICLE STANDARDS – 2019 FEES)

 

(JERSEY) ORDER 2018 - INCREASE IN FEES 2019

 

 

Purpose of the Report

 

To make the Infrastructure (Driver and Vehicle Standards – 2019 Fees) (Jersey) Order 2018, which will increase fees for services, in January 2019. 

 

 

Background

 

On the basis of Ministerial Decision MD-T-2018-0066, it was decided to increase fees for services provided by the Department by approximately 2.5%. Driver and Vehicle Standards charges have been rounded to the nearest pound, wherever possible, and this has resulted in a small number of charges increasing above 2.5%. However, these charges are relatively low in terms of income generation and the weighted average increase for DVS is actually below 2.5%.  The fees charged for services provided by Driver and Vehicle Standards are prescribed and require the Minister to make an Order to set the new fees.  Similarly, the fee charged by Jersey School of Motorcycling (JSM) for providing Compulsory Basic Training (CBT) is prescribed. This is set according to contractual arrangements with the provider such that the fee increases by the RPI(y) in September each year and as such there is an increase to the CBT fee for 2019.

 

 

Discussion

 

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.

 

The Infrastructure (Driver and Vehicle Standards – 2019 Fees) (Jersey) Order 2018 is attached for the Minister to make the Order.  Making the Order will implement the increases in charges and will come into force on 01 January 2019.

 

 

Recommendation

 

The Minister is recommended to make the Infrastructure (Driver and Vehicle Standards – 2019 Fees) (Jersey) Order 2018 and request the Department to take the necessary action to implement the Order.
