A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: 60 Les Cinq Chenes, St. Saviour and Westley Lodge and Westley Cottage, St. Helier: Lease of properties to Les Amis Incorporated.
Decision(s): The Minister resolved to recommend to the Minister for Treasury and Resources– 1, that the lease of 60 Les Cinq Chenes for 5 years commencing 1st January 2009 to Les Amis Incorporated for an initial rental of £12,147.72 per annum, together with service charges totalling £1,184.04 per annum plus GST, be approved; and 2. that the lease of Westley Lodge and Westley Cottage for 5 years commencing 1st January 2009 to Les Amis Incorporated for a combined initial rental of £22,781.72 per annum together with service charges totalling £538.72 per annum plus GST, be approved. requested that the Treasury & Resources Minister approve the transactions in accordance with Standing Order 168, seek the approval of the States and sign the leases on behalf of the Public.
Reason(s) for Decision: To ensure proper lease arrangements are in place and that these are approved in accordance with States Standing Order 168
Resource Implications: Financial: Rental Income of £36,652.20 per annum
Action required: In accordance with Standing Order 168 (2) (b) this recommendation must be presented to the Minister for Treasury and Resources for approval. Once the approval of the Minister for Treasury and Resources has been gained the Director of Estate Services is to oversee the signing of the lease.
