Former JCG site - development proposals

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved in principle development proposals from Grange Developments Limited for the former Jersey College for Girls site, subject to the agreement of detailed terms within a development agreement.

The Minister approved the sale of the former Jersey College for Girls sites to Grange Developments Ltd for a minimum land value of £1,800,000 plus profit sharing from any uplift in sale prices or additional value created from the sale of residential units to be developed in accordance with detailed terms to be set out in the Development Agreement.

The Minister delegated to the Director, Property Holdings, approval of the development agreement to reflect the terms set out in the proposal.

The Minister approved an extension of £50,000 to the funds earmarked in the Planning Vote Budget to underwrite the developer’s costs to date should the States determine that the proposed development not progress.

Reason(s) for decision:

The States approved the disposal of the site when approving the Property Plan in June 2006 (Appendix A to P40/2006).

The development proposals are preferred outcome from a competitive process that considered both effective use of the site and best return to the States for its asset.

The proposals are considered to provide an acceptable return to States given the SSI status and other restrictions imposed on the site.

The development agreement will protect the States interest in the site, guaranteeing a minimum land price and share in value uplift.

Action required:

Director of Property Holdings to progress the development agreement in accordance with the proposals.

The Director of Property Holdings to request the Greffier of the States to notify the States of the above decision.

The Greffier of the States to notify Property Holdings and the Law Officers’ Department of the date when the States has been notified.

After the expiry of 15 days following presentation to the States, the Attorney General and the Greffier of the States to pass any contracts on behalf of the Public of Jersey that may be necessary.

Treasury to extend planning vote budget provision by £50,000 to £150,000
