Social Security (Health Bonus Scheme) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Lodge the Draft Social Security (Health Bonus Scheme) (Jersey) Regulations 201-

Decision(s): The Minister decided to lodge au Greffe the Draft Social Security (Health Bonus Scheme) (Jersey) Regulations 201-.

Reason(s) for Decision: The Draft Social Security (Health Bonus Scheme) (Jersey) Regulations 201- will establish a scheme to provide assistance to lower-income pensioners with dental, optical and chiropody costs.  The scheme will replace the current Jersey 65+ Health Plan.  The Regulations will enact improvements to the current Plan identified by a departmental review that followed a commitment made in the 2016-2019 Medium-Term Financial Plan (MTFP) that the Plan would be improved.

Resource Implications: Enactment of the legislation and implementation of the new scheme will see changes to the administration of it and subsequent changes to the benefit levels are also anticipated (the latter to be made by Ministerial Order).  There are no additional financial implications in respect of benefit payments arising from approval of the Regulations, taking into account additional funding agreed within the MTFP.  In terms of the administration, bringing responsibility for the new Scheme within the Department will have implications as it will require activity of the Department which it does not currently undertake.  Manpower and resources will be required to develop the new scheme (including transition from the current Plan) but these will be accommodated within existing overall headcount and cash limits.  In relation to ongoing administration, as the new Scheme will be administered by the Department, there will no longer be any payment made to Westfield Health.  The current budget for administration will therefore be available to support the Department’s own ongoing administration in the future.

Action required: The Policy Principal to request the Greffier of the States to arrange for the Draft Regulations to be lodged au Greffe on 31st May 2016 and to be listed for debate at the States Assembly’s sitting of 12th July 2016.
