Jersey Competition and Regulatory Authority (JCRA): Executive Director Remuneration Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Exempt - 3.2.1 (a) (xiii).

Subject: Jersey Competition & Regulatory Authority Board remuneration - Executive Director Remuneration approval (Director)

Decision(s): The Minister approves the Director’s remuneration package under powers conferred by Article 5(1) of the Competition and Regulatory Authority (Jersey) Law 2001.  The full 2014 remuneration package including salary, pension contributions, etc paid by the JCRA IS £63,375. There is some small measure of variability in this figure for future years as remuneration contains an insurance component which may change slightly.

Reason(s) for Decision: The Minister must determine remuneration of JCRA Board members under Article 5(1). Following the creation of the Channel Island Competition and Regulatory Authorities (CICRA) the JCRA and Guernsey Competition and Regulatory Authority (GCRA) share a combined Board. To facilitate this, the members are appointed to both the JCRA and GCRA Boards.

 

The Director is a CICRA Board member by virtue of the role.

 

Additionally, the Director also supports the GCRA under the CICRA arrangements, and receives an equivalent sum from the GCRA, giving a total salary of £126,750.00.

 

Resource Implications: The Authority is funded via licence fees and a grant from the department to administer the Competition Law. No additional funding or resources are required as a consequence of this decision.

Action required: Inform the JCRA that the Minister has agreed the remuneration package as above.
