Primary Care Model Development 2013: Budget Transfer from Social Security

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A 2012 non-recurring budget transfer of £300,000 from the Social Security Department to Health and Social Services Department revenue head of expenditure to fund 2013 work to develop a new model of Primary Care.

 

Decision(s):

The Minister accepted the transfer of £300,000 from the Social Security Department in December 2012. The Minister noted that the Health & Social Services Department would need to carry forward this sum through year end processes and in accordance with Financial Direction 6.1 to fund work to be done in 2013 to develop a new model of Primary Care as outlined in P82/2012. It was further noted that the Treasury & Resources Department are aware of the transfer at year end and have included the £300,000 as a carry forward sum for the Health & Social Services Department.

 

Reason(s) for Decision:

Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

Section 5.1 of Financial Direction 3.6 states that Departments wanting to transfer funds between heads of expenditure must obtain the approval of their Minister or of their Accounting Officer where a scheme of delegation exists.

 

Resource Implications:

The Health & Social Services Department’s revenue head of expenditure to increase non-recurrently by £300,000 in 2012 and the Social Security Department’s revenue head of expenditure to decrease non-recurrently by the same amount. There is no overall increase to States spending as a direct result of this decision.

 

Action required:

 

  1. The Social Security Department seek the approval of their Minister to approve the budget transfer.
  2. The Minister for Treasury and Resources is requested to approve the transfer between the Social Security Department and the Health & Social Services Department
  3. The Treasury & Resources department transfer £300,000 non-recurrently in 2012 from the Social Security Department revenue head of expenditure to the Health & Social Services revenue head of expenditure.
