Budget Transfer from Central Contingency to Department for Infrastructure: Fort Regent Swimming Pool and Cable Car Station: Demolition

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Request for funding of up to £3 million from Central Contingency to the Department for Infrastructure (DFI) in connection with the demolition of the Fort Regent Swimming Pool Building and Cable Car Station and additional transfers from DFI to Central Contingency to collate all the costs of the project.

Decision(s):

The Minister approved:  

 

  1. The transfer of £800,000 from the Department for Infrastructure revenue head of expenditure to Central Contingency in relation to monies carried forward from 2016 for the demolition of the Cable Car Station at Snow Hill;
  2. The transfer of £750,000 from the Demolition of Fort Regent Pool capital head of expenditure (FA0MF14040) to Central Contingency; and
  3. The funding from Central Contingency to the Department for Infrastructure revenue head of expenditure of a total of up to £3 million by the end of 2019, this being a split of £1.5 million in 2018 and £1.5 million in 2019 in relation to costs associated with the demolition works at Fort Regent.

 

Reason(s) for Decision:

Article 18(1A) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from the head of expenditure to contingency expenditure, within or after the end of the relevant financial year.

 

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The current Contingency Allocation Policy (published as R.110/2017) sets the requirement for all allocations from Contingency over £100,000 to be considered by the Council of Ministers prior to submission to the Minister for approval.

 

At its meeting on 6th September 2017, the Council of Ministers approved funding in 2018 of up to a maximum of £1.5 million and also up to a further £1.5 million in 2019 from Central Contingency to Jersey Property Holdings to meet the costs associated with the demolition of the Fort Regent Swimming Pool building.

Ministerial Decision, MD-T-2017-0101 was signed by the Minister for Infrastructure on 5th December 2017.

Resource Implications:

The Demolition of Fort Regent Pool capital head of expenditure (FA0MF14040) budget to decrease by £750,000 and the Central Contingency budget to increase by £750,000 and to be ring-fenced for the demolition of Fort Regent Pool.

 

The Department for Infrastructure revenue head of expenditure to decrease by £800,000 and the Central Contingency budget to increase by £800,000 and to be ring-fenced for the demolition of the Fort Regent Cable Car Station.

A total of £3 million is to be ring-fenced within Central Contingency for the demolition of the Fort Regent Swimming Pool, split into £1.5 million in 2018 and £1.5 million in 2019.

 

Up to £3 million in total is proposed from Central Contingency as £1.5 million in 2018 and £1.5 million in 2019 but the amount for each year may be varied without exceeding the total amount for the two years.

 

The total amount within Central Contingency in relation to the demolition works at Fort Regent will total £4.55 million.

 

This decision does not change the total amount of expenditure approved by the States for 2017 – 2019 in the Medium Term Financial Plan.

Action required: The Head of Decision Support to advise the Finance Manager – Department for Infrastructure once this decision has been approved.
