Single qualified property classification - rescindment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Rescinding the introduction of a single qualified property classification.

Decision(s): The Minister rescinded the decision MD-H-2010-0001 dated 7th January 2010, which related to the introduction of a single qualified property classification.

Reason(s) for Decision: The Minister wishes to rescind MD-H-2010-0001 recognising the desire of many Members to debate matters of this nature.  

The Minister remains of the view that his decision was consistent with the principles contained within P25/2005 (Section 5.3) and the widely publicised recent consultation on the Migration Policy (Section D1) and that he had the appropriate power to make decision MD-H-2010-0001 under the Housing (Jersey) Law, 1949, and in doing so acted in the manner of successive Housing Committees.  

On the substance of the policy change, the Minister would re-iterate that he has no expectation that this change would have an effect on the overall level of prices – given the small proportion of Islanders who hold 1(1)(j) consent; given no additional 1(1)(j) consents would be issued as a consequence; and given the vast majority of housing is already available to 1(1)(j) employees. At the same time, general concerns and a desire to engage on the issues is evident. The Minister fully acknowledges this, and above all welcomes and values the primacy and judgement of the Assembly. 

Accordingly, a Report and Proposition on this matter will be lodged in March 2010, and briefings on these issues will be available in due course. 

This decision also supersedes MD-H-2010-0012 which suspended MD-H-2010-0001.

Action required: 

  1. All Housing consents granted under the Housing (Jersey) Law 1949, as amended to be issued in line with previous policy until otherwise agreed by the States.
  2. A Report and Proposition to be lodged “au Greffe” by the Minister for Housing on a Single Qualified Property Classification.
